DIGITAL PRODUCT TERMS OF PURCHASE

These Terms of Purchase apply to digital products purchased from Barboos Interiors (“Barboos Interiors,” “we,” “us,” or “our”), including the Kitchen Palette Library, Smart Storage System Planner, and any other downloadable guides, libraries, planners, templates, or digital resources sold through our website.

By completing a purchase, you agree to these Terms of Purchase.

1. Digital Product

You are purchasing a digital product. No physical product will be shipped.

The product description shown on the sales page at the time of purchase describes what is included in your purchase.

Unless expressly stated otherwise, the purchase is a one-time payment and does not create a subscription or recurring charge.

2. Delivery

Digital products are delivered electronically to the email address provided by you during checkout and/or through a download or access link provided after purchase.

You are responsible for entering a valid and accurate email address at checkout.

Delivery emails may occasionally be filtered into Spam, Junk, Promotions, or similar folders. If you do not receive or cannot access your purchase, please contact us at [email protected] and we will make reasonable efforts to restore or resend access.

A temporary email delivery, filtering, downloading, or access issue does not by itself mean the product has not been provided where we are able to promptly restore or resend access.

3. Refund Policy for Digital Products

Because our products are digital and customers receive access to the content shortly after purchase, purchases are non-refundable once the digital product has been delivered, downloaded, accessed, or made available to the purchaser, except where a refund or cancellation is required by applicable law.

If you experience a technical or delivery problem, please contact us before initiating a payment dispute so that we have an opportunity to resolve the issue and provide access to your purchase.

Nothing in these Terms limits any cancellation, refund, chargeback, or other consumer right that cannot legally be excluded or waived under applicable law.

4. Product Information and Design Disclaimer

Barboos Interiors digital products are provided for educational, informational, and design-inspiration purposes.

They are not a substitute for project-specific architectural, engineering, construction, electrical, plumbing, structural, building-code, safety, or other licensed professional advice.

Colors, finishes, materials, dimensions, product availability, pricing, manufacturer specifications, and other information may vary or change. Colors may also appear differently depending on screens, lighting conditions, printing, manufacturing variations, and surrounding materials.

Any inspiration images, renderings, AI-generated images, or other visual representations included in our products are illustrative. Small visual details may not precisely represent actual construction methods or product specifications. Where written specifications accompany an image, the written specifications should be treated as the primary reference.

Before purchasing, ordering, fabricating, installing, or constructing anything based on our materials, you should verify measurements, product specifications, availability, suitability, installation requirements, and applicable building codes with the appropriate supplier, contractor, tradesperson, or licensed professional.

5. Individual Results

Our digital products provide design guidance and resources, but we do not guarantee that any particular design, renovation, financial, property-value, aesthetic, or other result will be achieved.

The purchaser remains responsible for decisions made regarding their own home, renovation, purchases, contractors, materials, and installation.

6. Personal-Use License

Your purchase gives you a limited, non-exclusive, non-transferable license to use the digital product for your own personal use.

You may not:

resell or redistribute the product;

share the complete product or download link with others;

upload the product to another website, platform, file-sharing service, group, or database;

reproduce or republish substantial portions of the product;

sell, sublicense, copy, or create a competing commercial product substantially derived from our materials; or

represent our content as your own work.

All copyright and intellectual-property rights remain with Barboos Interiors and/or the applicable rights holder.

7. Purchases for Professional or Client Use

Unless a separate commercial or professional-use license is expressly included with the product, purchasing a digital product does not give you the right to redistribute the product to clients, customers, students, employees, or other third parties.

You may use ideas you learn from the material in your own projects, but you may not distribute or reproduce the product itself.

8. Prices and Payment

Prices are displayed at checkout in the currency identified on the checkout page.

You authorize the applicable payment processor -Stripe- to charge the payment method you provide for the total amount shown before you complete your purchase.

Applicable taxes, if any, will be displayed or applied as required.

9. Unauthorized Transactions and Payment Disputes

If you believe a transaction was unauthorized, duplicated, incorrectly charged, or the purchased product was not delivered, please contact us at [email protected] so that we can investigate and attempt to resolve the issue.

We may retain records relating to the transaction, including the order, payment, delivery, access, download, and customer-service history, for legitimate business, fraud-prevention, and dispute-resolution purposes.

Nothing in this section restricts any legal right you may have to dispute a transaction with your payment provider.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Barboos Interiors will not be liable for indirect, incidental, special, consequential, or similar damages arising from the use of, or reliance upon, a digital product.

To the maximum extent permitted by applicable law, our aggregate liability arising from a digital-product purchase will not exceed the amount you paid for that product.

These limitations do not apply where liability cannot legally be excluded or limited.

11. Updates

If your purchase expressly includes future updates, those updates will be provided according to the offer described at the time of purchase.

We may modify, reorganize, correct, expand, or discontinue individual portions of a digital product over time unless the purchase terms expressly state otherwise.

12. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Nothing in this section deprives a consumer of any mandatory rights or protections provided by the laws that apply to them and that cannot legally be waived by contract.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
